Media Release – SACC Statement on the Letter to the Public Protector

The SACC is an instrument and servant of its members.

The South African Council of Churches (SACC) confirms that the SACC wrote a letter on January 15, 2018, to the Public Protector, Advocate Busisiwe Mkhwebane, seeking clarity on the statement made by Adv. Mkhwebane on January 10, 2018, regarding the appointment by President Jacob Zuma of the Judicial Commission of Enquiry into State Capture.

The SACC recognises the Public Protector as the competent officer to clarify on any matter related to the execution of the remedial action prescribed in the Public Protector’s report. In that capacity, she is the owner of the 2016 report as the head of the Chapter 9 institution that is responsible for the report, and in terms of that report she is the monitor of the execution of that remedial action.

In this regard, the SACC requested clarification from Adv. Mkhwebane on the intended legal status of her call to the President to expand and nuance the terms of reference as cited in the Public Protector’s public statement. SACC has given the Public Protector the opportunity to respond on the matter, and can comment further once we have received her reply.
